Lunch & Learn: Getting it Right: Full or Part-time Employee Versus Independent Contractor

With the rise of the gig economy and the Great Resignation, more and more workers are striking out on their own. Business owners and workers alike may think that an independent contractor relationship is a win-win. However, misclassifying a worker as an “independent contractor” when they are legally considered an “employee” opens employers up to significant liability. Most people don’t realize that whether you agree in a contract, or whether you pay someone on a 1099 is not the deciding factor, because the law defines both of these classifications. In this program, Valerie will discuss how to determine whether a person you hire should be an employee, even if they want to be an independent contractor, the risks of getting it wrong, and ways to avoid getting in trouble.
About Presenter Valerie Ferrier
Valerie K. Ferrier has been an employment lawyer for fifteen years and is Co-Chair of the Labor & Employment Practice Group at Kane Kessler, P.C. She works with business owners to help them understand and comply with the law in multiple jurisdictions. Valerie drafts employment and separation agreements and employee handbooks, conducts anti-harassment training, defends overtime and discrimination cases, and provides advice to clients. Valerie acts as “external HR” for many small businesses who don’t have the need or resources for a full-time HR Department, but still have all the same day to day HR-issues as any Fortune 500 company.

Building on the virtual community that has formed as a result of the past couple of years, we are pleased to present our new Lunch & Learn program. Our Lunch & Learns provides a monthly opportunity to learn about various topics presented by Subject Matter Experts (SME) from the nglccNY and network with members that are both in the NYC area and beyond.
Each virtual Lunch & Learn includes a 30-45 minute presentation of a topic from a SME, and will also allow time for networking during a breakout session.
